1. Agreement

These terms apply to the Tallyleaf iPhone app ("the App"), made by SoSo Family ("we", "us"), based in British Columbia, Canada. By downloading or using the App you agree to these terms and to Apple's Licensed Application End User License Agreement (the "Apple EULA"). If these terms and the Apple EULA conflict, these terms apply to the extent the Apple EULA allows. If you do not agree, please do not use the App.

2. Not a Medical Device, Not Medical Advice

Tallyleaf is a personal log, not a medical device. It is not intended to diagnose, treat, cure, monitor or prevent any disease or condition.

• The App does not calculate, recommend or adjust doses, does not convert between milligrams and units, and does not tell you what to do about a missed or late dose.
• Every dose, date and value in the App is typed in by you. The App shows back what you entered; it does not check whether it is correct or safe.
• Reminders are a convenience. They depend on your iPhone's settings, battery and notification permissions and may not arrive. Do not rely on the App as your only reminder to take a medicine.
• Charts and reports summarize your own entries. They are not a clinical assessment.

Always follow the instructions of your doctor, pharmacist or other healthcare professional, and the information that comes with your medicine. If you think you may have a medical emergency, contact your local emergency number right away.

3. Your Responsibilities

• You are responsible for the accuracy of what you enter and for any decisions you make about your health.
• You are responsible for keeping your iPhone secure and for making backups. Your data exists only on your device and in files or backups you create. We cannot recover it.
• You are responsible for where you send files you export (for example by email or messages).
• You must use the App only for lawful purposes and in line with the Apple Media Services Terms.

4. Medicine Names and Trademarks

The App lists medicines by generic name and may list brand-name, generic and compounded products so you can record what you use. Listing a product does not mean we endorse it, or that it is approved, available or appropriate for you where you live. Product lists may be incomplete or out of date; you can add your own entry.

Ozempic®, Wegovy® and Rybelsus® are trademarks of Novo Nordisk A/S. Mounjaro® and Zepbound® are trademarks of Eli Lilly and Company. Other product names belong to their owners. Tallyleaf is not affiliated with, endorsed by or sponsored by any of them.

5. Tallyleaf Plus (One-Time Purchase)

• The App's core features are free. Tallyleaf Plus is an optional one-time, non-consumable in-app purchase. It is not a subscription and does not renew.
• The price is shown in the App before you buy and is set in your local currency by the App Store.
• Purchases are processed by Apple under Apple's terms. We do not handle payment or refunds; refund requests go to Apple at reportaproblem.apple.com.
• You can restore Plus on your devices signed in with the same Apple Account using "Restore Purchases" in the App. If Family Sharing is available for Plus, family members may use it too.
• Plus unlocks the features described in the App at the time of purchase. We may improve, change or add features over time. If we remove a Plus feature you paid for, we will try to provide a reasonable replacement.
• Backup and export of your data are free and will stay free. You will never have to buy Plus to get your own data out of the App.

6. Licence

We grant you a personal, non-transferable licence to use the App on Apple devices you own or control, as set out in the Apple EULA. You may not copy, modify, reverse engineer or redistribute the App except as the law allows.

7. Updates and Availability

We may release updates, including updates to medicine lists and iOS compatibility. Some updates may be needed to keep using the App. We may stop offering the App in the future. Because your data is stored on your device, it will not be deleted by us if that happens, but you should keep an export.

8. Disclaimer of Warranties

To the fullest extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that reminders will be delivered, or that data will never be lost.

9. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, or for any harm arising from health or treatment decisions, missed or late doses, or reliance on anything in the App. Our total liability for any claim relating to the App will not exceed the amount you paid us for the App and Tallyleaf Plus in the 12 months before the claim, or US$15 if you paid nothing.

Some places do not allow certain warranties to be excluded or liability to be limited, including for death or personal injury caused by negligence. Nothing in these terms limits any rights you have under consumer protection law that cannot be waived by contract.

10. Governing Law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Any dispute will be heard in the courts of British Columbia, unless the consumer protection law of the place where you live gives you the right to bring it in your local courts or under your local law.

11. Apple

These terms are between you and SoSo Family, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for addressing any claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Privacy

How the App handles information is described in the Privacy Policy. In short: no account, and we do not collect data from the App.

13. Changes to These Terms

We may update these terms. We will post the new version here and update the date above. If a change is significant, we will also mention it in the App. Continuing to use the App after a change means you accept the new terms.
